Terms of Service

Welcome to Tempo. These Terms of Service ("Terms") govern your use of the Tempo platform operated by Tempo Training LLC. You accept them when you create an account, and we record that acceptance together with the version you accepted. If you do not agree to these Terms, please do not use the Service.

1. Definitions

"Service" refers to the Tempo platform, including our website, iOS app, the connector we provide for AI assistants, and related services provided by Tempo Training LLC.

"User," "you," or "your" means anyone who accesses or uses the Service.

"We," "us," or "our" refers to Tempo Training LLC.

"Your Content" means the data, files, text, and images you submit to the Service or that arrive through the devices and services you connect.

"Premium" means the paid subscription tier of the Service.

2. Acceptance of Terms and Age Restrictions

You must be at least 16 years old to use the Service. By creating an account you represent that you are at least 16 years of age, that the information you provide is accurate, and that you have read our Privacy Policy.

3. Health Disclaimer

The Service provides fitness insights and recommendations based on your data. It is not medical advice, diagnosis, or treatment, and it is not a substitute for a physician or a qualified coach. Always consult a physician before starting a training program or making health decisions, and stop exercising and seek medical help if you feel unwell.

Physical exercise carries inherent risks. You use the Service and follow its recommendations at your own risk, and you voluntarily assume those risks. To the extent permitted by law, we are not responsible for injuries or health issues that result from following training, recovery, or fueling recommendations provided through the Service.

4. Your License to Use the Service

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service and our apps for your own training for as long as you have an account. You may export your own data from the Service. This license does not permit you to:

  • Copy, resell, sublicense, or commercially exploit the Service or any content we provide, other than your own data
  • Scrape the Service or access it by automated means other than the connector and API keys we provide for that purpose
  • Reverse engineer, decompile, or attempt to extract the source code of our apps or models, except where the law expressly allows it
  • Circumvent Premium gating, rate limits, or other technical restrictions
  • Remove any copyright, trademark, or attribution notice, including the data-provider attributions shown in the app

5. Account Responsibilities

You are responsible for keeping your password, passkeys, and any API keys you create confidential, and for everything that happens under your account, including actions taken by an AI assistant or other tool you have connected to it. Tell us at security@jointempo.ai if you believe your account has been compromised.

You agree to provide accurate, current, and complete information during registration and to keep it accurate, current, and complete.

6. Your Content and Teams

You retain ownership of Your Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and transmit it solely to operate and improve the Service, including to show it to the people and assistants you choose to share it with. This license ends when you delete the content or your account, except for copies in backups that expire on their own schedule.

Teams are shared spaces. Content you post to a team, and the workouts you share with it, are visible to every member of that team. Team admins may pin or remove content and may remove members. If you delete your account, the teams you administer pass to another admin or are deleted. Workout sharing is controlled per team in your settings, as described in our Privacy Policy.

You are responsible for ensuring Your Content complies with applicable laws and does not infringe third-party rights. You agree not to submit content that is:

  • Illegal, harmful, threatening, abusive, harassing, or otherwise objectionable
  • Infringing on any patent, trademark, copyright, or other proprietary rights
  • False, misleading, or fraudulent
  • Containing viruses or other harmful computer code

7. Subscriptions and Payment

The Service has a free tier and a Premium subscription. Premium is sold on the web through Stripe and on iOS through Apple In-App Purchase. The price and billing period are shown before you buy.

  • Automatic renewal: Premium renews automatically at the end of each billing period, at the price shown when you subscribed, until you cancel.
  • Cancellation: Cancel at any time. Web subscriptions are managed through Manage Subscription in Settings → Plan & Access, which opens Stripe's billing portal; Apple purchases are managed in your Apple ID subscription settings, and only there: deleting your Tempo account does not cancel an Apple subscription. Premium access continues until the end of the period you have already paid for, and no further charges are made.
  • Failed payments: If a renewal payment fails, Premium stays active while the payment is retried. If it cannot be collected, your account returns to the free tier.
  • Price changes: We will email you at least 30 days before a price change takes effect. If you do not agree, cancel before the new price applies.
  • Refunds: Apple handles refunds for iOS purchases under its own policies. For web purchases, email support@jointempo.ai; refunds are at our discretion except where the law gives you a right to one.
  • Taxes: Prices may exclude taxes, which are added at checkout where applicable.

8. AI Features and Connected Assistants

You may connect an AI assistant of your choice (for example Claude or ChatGPT) to the Service through our connector. What the assistant says is generated by its provider, not by us; it may be wrong, out of date, or unsafe for your situation, and it is not medical advice. Anything an assistant creates, changes, or deletes in your account with your authorization is treated as your own action. You are responsible for the API keys you create and for revoking them when you no longer need them. Your use of the assistant itself is governed by its provider's terms.

9. Third-Party Services and Integrations

The Service can import data from, and send workouts to, third-party services such as Wahoo, Garmin, Strava, Withings, WHOOP, Hammerhead, TrainerRoad, and Apple Health. Your use of those services is subject to their own terms. We are not responsible for their availability, for changes they make to their APIs, or for the accuracy of the data they send us. Data we display from a provider carries that provider's attribution where its terms require it.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect your information, and our Cookie Policy describes the cookies and browser storage we use. Health data is processed only with the consent you give when you create your account.

11. Service Changes and Beta Features

We may add, change, or discontinue parts of the Service at any time. Where a change materially reduces what a paid subscription includes, we will tell you in advance. Features labelled beta are provided as-is, may change or be removed without notice, and may not work as expected.

12. Prohibited Uses

You may not use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information, or to access another user's account or data
  • To upload or transmit viruses or any other type of malicious code
  • To interfere with, probe, or circumvent the security features of the Service (see our Security page for how to report a vulnerability responsibly)

13. Termination

We may suspend or terminate your access to the Service at any time, without notice or liability, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate. You may delete your account at any time in Settings; cancel an Apple subscription in your Apple ID settings first, because deleting the account does not cancel it.

Upon termination, your right to use the Service ceases. Sections 3, 6, 8, 14, 15, and 17 survive termination.

14. Limitation of Liability

To the fullest extent permitted by law, Tempo Training LLC and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service
  • Any errors or omissions in any content, including content generated by a connected AI assistant, or any loss or damage incurred as a result of your use of any content

Our total liability to you for all claims relating to the Service is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.

15. Indemnification

You agree to indemnify and hold harmless Tempo Training LLC and its affiliates, officers, agents, employees, and partners from any claim, demand, or damages, including reasonable attorneys' fees, arising from Your Content, your use of the Service, or your violation of these Terms.

16. International Use

The Service is controlled and operated from the United States. If you access the Service from outside the U.S., you are responsible for compliance with local laws. We make no representations that the Service is appropriate or available for use in other locations.

17. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tempo Training LLC regarding the use of the Service, superseding any prior agreements between you and us relating to the Service.

19. Changes to Terms

We may modify these Terms. We will post the new Terms on this page with a new effective date and email you about material changes before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
